UVC Facebook and Instagram (Hereafter collectively referred to as “Social Media”) Live Trivia Terms & Conditions.
NO PURCHASE NECESSARY TO PARTICIPATE OR WIN. PURCHASES DO NOT INCREASE YOUR CHANCES TO WIN.
- Trivia. Contest organized and sponsored by UVC on their Social Media “live broadcasts” and/or “LIVE”.
- Rules. As determined and applicable for each Trivia contest.
- Eligibility. Trivia participants must be: I) individuals with a valid UVC contract (collectively referred to as “UVC Members”); II) 18 years of age at the time of registration and participation.
UVC employees, its subsidiaries, advertising and promotion agencies, and its contractors and their immediate family and/or household members (collectively referred to as “employees”) are not eligible to enter and participate in the Trivia contests.
- Releases. By participating, “entrants” (hereinafter referred to as “You”) agree to be bound unconditionally to these Terms and Conditions, and to the Rules established for every TRIVIA contest, and You express and warrant that you meet all the participation requirements. Moreover, You agree and accept the decisions made by UVC, which are final and binding in regards to the content broadcasted live. Trivia validity period is only active for the duration of the live broadcast on each of UVC´s Social Media platforms where the contest is being held in accordance with the Trivia Rules.
- Entry Rules. To enter the Trivia contest, participants must follow the Rules and meet the established requirements of eligibility to obtain a prize. Any entry that is incomplete, incorrect, or failing to meet the Rules described during the live broadcast may be disqualified at UVC sole discretion. Participants must present all the required information.
- Prizes. Winners of live broadcasted Trivias (hereinafter referred to as (“The Winner”) will receive the prize described during the live broadcast accordingly, prizes vary. The actual/estimated value of the prize may vary at the time of delivery. The prize-specific features are determined solely by UVC. The prize is not redeemable for cash or transferable. No substitution allowed except, at UVC’s sole discretion. Prize winners are solely responsible for any applicable expense, including but not limited to federal, state, and/or local taxes. The Winner is not permitted to request prize substitution or transfer/assignment to third parties or to receive prize value in cash. By accepting any prize, they may win, Winner expressly authorizes UVC to use their name and/or likeness, and their entry materials for advertising and commercial purposes without further obligation or compensation.
- Odds. The odds of winning will depend on being the first participant to meet all Entry Rules, eligibility requirements, and criteria specified during UVC´s Trivia live broadcast.
- Winner Selection and Notification. The Winner will be selected by UVC based on their fulfillment of Trivia Rules. The Winner will be informed by private social media message or registered email.
9. Disclaimer of Responsibility. UVC is not responsible if the Winner fails to receive the notice about the prize due to spam filters, junk mail, unread email messages, or any other security settings or provision of incorrect contact information or malfunctions of the email or in any of the social platforms hosting the Trivia. If the winner fails to respond within 5 calendar days from the notice date or fails to submit the required declaration and authorization form completed and in a timely manner, the prize may be forfeited and an alternate Winner may be selected based on the established Rules.
By accepting any of the prizes offered in the Trivia, The Winner is conditioned to comply with any applicable law and federal, state, and local regulations. ANY VIOLATION TO ANY OF THE RULES HEREBY ESTABLISHED THAT WINNERS MAY INCUR AND AT THE SOLE DISCRETION OF UVC, WILL RESULT IN IMMEDIATE DISQUALIFICATION AS A TRIVIA WINNER AND REMOVAL OF ALL WINNER PRIVILEGES.
- Rights Granted By You. By entering this content (e.g. photo, video, text, etc.), You understand and agree that UVC, anyone acting on behalf of UVC, and its licensees, successors and assigns will have the right, where permitted by law, to print, publish, transmit, distribute and use in any media now known or hereafter created or conceived, worldwide in perpetuity, without limitation, your entry, name, portrait, likeness, voice, photograph, statements about the TRIVIA and biographic information for informative, news, advertising, commercial, marketing, public relations and promotional purposes without further obligation or compensation, notice, review or consent. By submitting this content, You express and warrant that, if applicable, your work or creation is your original authorship and does not violate any copyright or intellectual property of any third party. If the content of your entry infringes any intellectual property rights, UVC may disqualify you at its sole discretion. If the content of your entry constitutes an infringement of copyright or intellectual property of any third party which results in a lawsuit, You shall, by your own means, defend and settle such claims, and indemnify, defend and hold UVC harmless of any action, legal proceeding, claim, liability, loss, damage, cost or expense in which UVC may incur, suffer or have the obligation to pay as a result of such infringement or alleged infringement to any third-party rights.
- Cancellation and Disqualification. UVC reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the TRIVIA should virus, bug, non-authorized human intervention, fraud, or any other cause out of UVC´s control corrupts or affects the administration, security, fairness, or proper conduct of the TRIVIA. If such a case occurs, UVC may select the Winner from all eligible entries received before and/or after (if appropriate) any action taken by UVC.
UVC reserves the right, at its sole discretion, to disqualify any individual who tampers or attempts to tamper with the participation process or the operation of the TRIVIA, social media channels, or website or who fails to meet these Terms and Conditions.
UVC holds the right, at its sole discretion, to maintain the integrity of the TRIVIA, to void Your and any user´s entry that by any reason, including but not limited to: mass entries by the same user from different IP addresses; mass entries from the same computer in a larger quantity than those established in the Trivia Rules; or use of automated methods (bots), script, macro or any other technical participation resource.
Attempts made by You or other participants to deliberately damage any website or obstruct the legitimate operation of the Trivia may be a violation of criminal and civil laws. If such an attempt is detected, UVC holds the right to claim for damages and losses to the fullest extent permitted by law.
The software system of our contest platform detects participants using robots and/or email generators to increase their chances of winning. In order to maintain the fairness of the contest, participants using any method that may tamper with the contest will be automatically disqualified.
- Limitation of Liability. By entering, You agree to release and hold harmless UVC and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) your participation in the Trivia and/or your acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) electronic or human error in the administration of the promotion or the processing of entries.
- Disputes. The Trivia contests are governed by the laws of the United States of America and the United Mexican States, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in the Trivia, You and the participants agree that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with The Trivia, shall be resolved individually, without resort to any form of class action, exclusively before a competent court located in the United States of America or the United Mexican States as the case may be. In addition to this, in such dispute, it is not permitted for participants to receive, under any circumstance, and hereby waive their rights to demand, in any circumstances, payment of punitive damages, incidental, and consequential damages, including attorney´s fees, various expenses in which the participant incurred (i.e., expenses associated with the participation of this Campaign). The participant hereby irrevocably waives any right to multiply or increase the damages.
- Privacy Policy. Information submitted with your entry is subject to the Privacy Policy stated on the Unlimited Vacation Club website.
- Sponsor. Unlimited Vacation Club is the Sponsor and responsible for the Trivia. The Trivias are organized by Unlimited Vacation Club and under any circumstance are sponsored, endorsed, administered, or associated with Facebook, Instagram, or any other social network.
- Acceptance. By participating in this Trivia contest, You positively accept reading, understanding, and agreeing to all these Terms and Conditions and Rules applicable to the current Trivia.
- Legislation. TRIVIA contests are subject to the legislation and jurisdiction set forth in the Rules of each Trivia.
