Contest Rules:

 

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.

 

  1. Eligibility: This Campaign is open only to UVC members who follow the Unlimited Vacation Club Twitter account @unlimitedvc and who are 18 or older as of the date of entry. The prize (s) of all UVC Contests are exclusive to first-time winners with a different UVC membership number. All other applicable prizes may be won by past winners. The Campaign is only open to Unlimited Vacation Club Members (will be verified by entering membership number) and is void where prohibited by law. Employees of Unlimited Vacation Club, its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (collectively the “Employees”), and immediate family members and/or those living in the same household of Employees are not eligible to participate in the Campaign. The Campaign is subject to all applicable federal, state, and local laws and regulations. Void where prohibited

 

  1. Agreement to Rules: By participating, the Contestant (“You”) agrees to be fully unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of the Unlimited Vacation Club as final and binding as it relates to the content of this Campaign.

 

  1. Campaign Period: Registered entries will apply and will be the only eligible participants for winning the final prize to those members that quote tweet from June 15th, 2021 to June 30th, 2021.

 

  1. How to Enter: Each participant must Quote Tweet her/his very first UVC vacation picture under the tweet posted the June 15th, 2021 and branded with the “THROW ME BACK” image campaign. The post will be pinned at the top of the Official UVC Twitter Profile (@UnlimitedVC). The entry must fulfill all Campaign requirements, as specified, to be eligible to win a prize. Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion of the Unlimited Vacation Club. You must enter only once. You must provide the information requested. You may not enter more times than indicated by using your Twitter profile. If You use fraudulent methods or otherwise attempt to circumvent the rules, your submission may be removed from eligibility at the sole discretion of the Unlimited Vacation Club.

 

  1. Prizes: The Winners of the Campaign (the “Winner”) will receive: 2-Nights stay at the Dreams Resorts & Spas of your choice.

 

  1. Winner Selection and Notification: The contest takes place from June 15 – 30, 2021. A random winner will be selected by the Social Media team among the users based on their fulfillment for meeting the overall intent of the contest: the entry with the most likes and retweets. (They will be announced on July 1, 2021). The winner will be announced on our UVC Social Media Channels on July 1 2021. Unlimited Vacation Club shall have no liability for Winner’s failure to receive notices due to spam, junk e-mail, or other security settings or for Winner’s provision of incorrect or otherwise non-functioning contact information. If the winner cannot be contacted, is ineligible, fails to claim the prize within 3 days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited and an alternate Winner selected. Receipt by the Winner of the prize offered in this Campaign is conditioned upon compliance with any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER (AT Unlimited Vacation Club ‘S SOLE DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE CAMPAIGN, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

 

  1. Rights Granted by You: By entering this content (e.g., photo, video, text, etc.), You understand and agree that Unlimited Vacation Club, anyone acting on behalf of Unlimited Vacation Club, and Unlimited Vacation Club’s licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the Campaign, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes. without any further compensation, notice review, or consent. By entering this content, You represent and warrant that your entry is an original work of authorship, and does not violate any third party’s proprietary or intellectual property rights. If your entry infringes upon the intellectual property right of another, You will be disqualified at the sole discretion of the Unlimited Vacation Club. If the content of your entry is claimed to constitute an infringement of any proprietary or intellectual proprietary rights of any third party, You shall, at your sole expense, defend or settle against such claims. You shall indemnify, defend, and hold harmless Unlimited Vacation Club from and against any suit, proceeding, claims, liability, loss, damage, costs, or expense, which Unlimited Vacation Club may incur, suffer or be required to pay to arise out of such infringement or suspected infringement of any third party’s right.

 

  1. Terms & Conditions: Unlimited Vacation Club reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Campaign should virus, bug, non-authorized human intervention, fraud, or other cause beyond Unlimited Vacation Club’s control corrupt or affect the administration, security, fairness, or proper conduct of the Campaign. In such case, Unlimited Vacation The club may select the Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Unlimited Vacation Club. Unlimited Vacation Club reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Campaign or website or violates these Terms & Conditions. Unlimited Vacation Club has the right, in its sole discretion, to maintain the integrity of the Campaign, to void votes for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Campaign rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Campaign may be a violation of criminal and civil laws. Should such an attempt be made, the Unlimited Vacation Club reserves the right to seek damages to the fullest extent permitted by law.

 

  1. Limitation of Liability: By entering, You agree to release and hold harmless Unlimited Vacation Club and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the Campaign and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error in the administration of the Promotion or the processing of entries

 

  1. Disputes: THIS Campaign IS GOVERNED BY THE LAWS OF the United States of America AND Mexico WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Campaign, the participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Campaign, shall be resolved individually, without resort to any form of class action, exclusively before a court located in the United States of America having jurisdiction. Further, in any such dispute, under no circumstances shall the participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Campaign). Participants further waive all rights to have damages multiplied or increased.

 

  1. Privacy Policy: Information submitted with an entry is subject to the Privacy Policy stated on the Unlimited Vacation Club website.

 

  1. Sponsor: The Sponsor of the Campaign is the Unlimited Vacation Club.

 

  1. The Campaign hosted by Unlimited Vacation Club is in no way sponsored, endorsed, administered by, or associated with Twitter.

 

  1. By participating in the contest, You, the Contestant, have affirmatively reviewed, accepted, and agreed to all of the Official Rules & Regulations.

 

  1. The Contest Platform System will indicate if Robot and/or Email Generator systems are used to cast extra bonus points. To maintain the fairness of the contest, participants using these methods to increase their chances to win will be automatically disqualified when determining the winners at the end of the month.

 

 

 

 

 

Reglas del Concurso:

1.Admisión: Esta Campaña está abierta únicamente a los socios UVC quienes sigan la cuenta Unlimited Vacation Club @unlimitedvc en Twitter y sean mayores de 18 años a la fecha de inscripción. El premio del primer lugar de todos los concursos UVC es exclusivo solamente para los que sean ganadores por primera vez con número de socio UVC distinto. Todos los otros premios pueden ser ganados por ganadores pasados. Únicamente los Socios de Unlimited Vacation Club podrán participar en la Campaña (se solicitará verificación con el número de membresía). La Campaña es nula en donde lo prohíba la ley. Los empleados de Unlimited Vacation Club, sus afiliados, subsidiarios, agencias de publicidad y promoción, y sus proveedores (llamados en conjunto los “Empleados”) y sus familiares directos y/o quienes compartan el mismo domicilio con los empleados no serán elegibles para participar en esta Campaña. La Campaña está sujeta a todas las leyes y normas federales, estatales y locales.

 

 

  1. Aceptación del Reglamento: Con su participación, el “Concursante” (“Usted”) acepta estar obligado de manera incondicional por estas Reglas, y Usted declara y garantiza que Usted cumple con todos los requisitos de admisión. Además, Usted está de acuerdo en aceptar las decisiones tomadas por Unlimited Vacation Club como definitivas y vinculantes en lo que refiere al contenido de esta Campaña.

 

  1. Vigencia de la Campaña: Se aceptarán las participaciones y serán los únicos participantes elegibles para ganar el premio final a los socios que compartan y comenten en un “tuit” entre el 15 y 30 de junio del 2021.

 

  1. Mecánica de Participación: El participante debe publicar en un Tuit su primera foto de vacaciones UVC bajo el primer tuit publicado el 15 de junio, 2021 con la imagen de la campaña “THROW ME BACK”. La publicación se fijará en la parte superior del Perfil Oficial de UVC en Twitter (@UnlimitedVC). Se debe cumplir con todos los requisitos de participación de la Campaña, tal como se especifica, para poder calificar para la obtención de un premio. Las participaciones incompletas o que no cumplan con las reglas o especificaciones podrán ser descalificadas a criterio exclusivo de Unlimited Vacation Club. Solo puede participar una vez. Es necesario presentar toda la información solicitada. No se permiten más participaciones de las indicadas utilizando su perfil de Twitter. Si utiliza métodos fraudulentos o intenta eludir las reglas de cualquier manera, su participación podrá ser descalificada a la entera discreción de Unlimited Vacation Club.

 

  1. Premios: Los Ganadores de la Campaña (el “Ganador”) recibirá una estancia de 2 Noches para 2 personas en la propiedad Dreams Resorts & Spas de su preferencia.

 

  1. Selección del Ganador y Notificación: El concurso se llevará a cabo del 15 al 30 de junio, 2021. El equipo de Social Media seleccionará un ganador entre todos los participantes con base en el cumplimiento de los requisitos para lograr el objetivo general del concurso: Tener la participación con más Me Gusta y Retweets. El ganador se anunciará el 1 de julio de 2021 en los Canales Oficiales de UVC en Redes Sociales. Unlimited Vacation Club no será responsable por cualquier impedimento del Ganador para recibir notificaciones, sin limitación por mencionar alguna, correo spam, basura, no leídos o cualquier otra configuración de seguridad o por errores al momento de brindar su información de contacto. Si el Ganador no puede ser contactado, está descalificado, no reclama el premio dentro de los 3 días a partir de que fue enviada la notificación, o no envía la declaratoria y autorización requerida ejecutada y completa de manera oportuna ejecutada, perderá su premio y se elegirá a un Ganador alternativo. La aceptación del Ganador de cualquiera de los premios ofrecidos en esta Campaña está condicionada al cumplimiento de cualquier ley y reglamento federal, estatal y local. CUALQUIER VIOLACIÓN POR PARTE DEL GANADOR A CUALQUIER DE LAS REGLAS OFICIALES (A LA ENTERA DISCRECIÓN de Unlimited Vacation Club) CAUSARÁ LA DESCALIFICACIÓN COMO GANADOR DE LA CAMPAÑA Y TODOS LOS PRIVILEGIOS COMO GANADOR SERÁN RETIRADOS INMEDIATAMENTE.

Derechos Otorgados por Usted: Al ingresar este contenido (ejemplo: foto, video, texto, etc.), Usted entiende y acepta que Unlimited Vacation Club, cualquier individuo que actúe en nombre de Unlimited Vacation Club y los concesionarios, sucesores y asignados de Unlimited Vacation Club tendrán el derecho, donde la ley lo permita, a imprimir, publicar, transmitir, distribuir y utilizar por cualquier medio conocido hasta ahora o próximo a desarrollarse, a perpetuidad y en todo el Mundo, sin limitantes, su participación, nombre, retrato, imagen, voz, fotografía, declaraciones sobre la Campaña y la información biográfica para fines informativos, de noticias, publicitarios, mercantiles, relaciones públicas y promocionales. Sin derecho a compensación, aviso, revisión o autorización adicional. Al ingresar este contenido, Usted declara y garantiza que es un trabajo original de su autoría, y que no viola los derechos de autor o propiedad intelectual de terceros. Si su participación infringe la propiedad intelectual de alguien más, Unlimited Vacation Club podrá descalificarlo a su sola discreción. Si el contenido de su participación es demandado por constituir una infracción a los derechos de propiedad o intelectuales de terceros, Usted deberá, por sus propios medios, defender o resolver tales reclamaciones. Usted deberá indemnizar, defender y eximir a Unlimited Vacation Club de cualquier demanda, procedimiento, reclamo, responsabilidad, pérdida, daño, costo o gasto en los que Unlimited Vacation Club pudiera incurrir, sufrir o ser obligado a pagar como resultado de tal infracción o supuesta infracción a los derechos de terceros.

 

  1. Términos y Condiciones: Unlimited Vacation Club se reserve el derecho, a su exclusiva discreción, de cancelar, terminar, modificar o suspender la Campaña si algún virus, error de programación, intervención humana no autorizada, fraude o cualquier otra fuera del control de Unlimited Vacation Club corrompiera o afectará la administración, seguridad, imparcialidad o conducta apropiada de la Campaña. En dicho caso, Unlimited Vacation Club podría seleccionar al Ganador de entre las participaciones calificadas que se hayan recibido antes a y/o después (si se considera oportuno) de las acciones tomadas por Unlimited Vacation Club. Unlimited Vacation Club se reserva el derecho, a su exclusiva discreción, de descalificar a cualquier individuo que manipule o intente manipular el proceso de participación o la operación de la Campaña o el sitio web o que incumpla con estos Términos y Condiciones. Unlimited Vacation Club tien el derecho, a su exclusiva discreción, de mantener la integridad de la Campaña, de anular votos por cualquier razón, incluyendo, pero sin limitarse a: múltiples participaciones del mismo usuario desde diferentes direcciones IP; múltiples participaciones desde la misma computadora en mayor número al permitido por las reglas de la Campaña; o el uso de bots, macros, scripts o cualquier otro recurso técnico para participar. Cualquier intento por parte de un participante para dañar de manera deliberada algún sitio web o perjudicar la operación legitima de la Campaña puede significar una violación a las leyes penales y civiles. Limitación de Responsabilidad: Con su participación, Usted acepta a eximir y liberar a Unlimited Vacation Club y a sus afiliados, subsidiarios, agencias de publicidad y promoción, asociados, representantes, agentes, sucesores, asignados, empleados, oficiales y directores de cualquier responsabilidad, enfermedad, lesión, muerte, pérdida, litigio, reclamación o daño que pudiera ocurrirle, de manera directa o indirecta, ya sea por causa de negligencia o no, resultante de: (i) su participación en la Campaña y/o su aceptación, posesión, uso o uso incorrecto de cualquier premio o parte del mismo; (ii) fallas técnicas de cualquier índole, incluyendo, pero sin limitarse a fallas en el equipo de cómputo, cable, red, equipos o programas, o cualquier otro equipo mecánico; (iii) la falta de disponibilidad o acceso a transmisiones, teléfonos o servicio de internet; (iv) error electrónico o humano en la administración de la Promoción o el procesamiento de participaciones.

 

  1. Impugnaciones: ESTA Campaña SE RIGE POR LAS LEYES de Estados Unidos de Norteamérica y México SIN CONSIDERACIÓN DE LAS DOCTRINAS JURÍDICAS. Como una condición a su participación en esta Campaña, el participante acepta que cualquier disputa que no pueda ser resuelta entre las partes y sea causa de acción resultante de o en relación con esta Campaña, deberá ser resuelta de manera individual, sin recurrir a ninguna forma de acción de clase, exclusivamente ante un tribunal competente situada dentro de los Estados Unidos de Norteamérica que tenga jurisdicción. Adicional a esto, en dicha impugnación, no se permitirá al participante recibir, y por este medio renuncia a todos sus derechos a recibir, bajo ninguna circunstancia, indemnización por daños punitivos, incidentales o consecuenciales, incluidos los honorarios de abogados, diferentes a los gastos hechos por el participante (i.e. costos asociados a la participación en esta Campaña).   1. Política de Privacidad: información ingresada con su participación está sujeta a la Política de Privacidad publicada en el sitio web de Unlimited Vacation Club.

 

  1. Patrocinador: Unlimited Vacation Club es el Patrocinador de esta Campaña.

 

  1. Esta Campaña está organizada por Unlimited Vacation Club y bajo ninguna circunstancia está patrocinada, respaldada, administrada o asociada a Twitter.

 

  1. Con su participación en el concurso, Usted, el Participante, acepta afirmativamente haber revisado, aceptado y estar de acuerdo con todas la Reglas Oficiales y el Reglamento.

 

  1. El Sistema Informático de nuestra plataforma de concursos detecta el uso de robots y/o sistemas generadores de correos electrónicos para incrementar sus puntos. A fin de mantener la equidad del concurso, los participantes que utilicen cualquier método para incrementar sus oportunidades de ganar serán automáticamente descalificados al momento de elegir a los ganadores a finales del mes.
